How money does it cost to evict a tenant?
What is the correct procedure for getting a tenant evicted when he refuses to do so even though I served him with a notice? How hard is it to evict a tenant when the tenancy agreement has expired? While I go about getting the eviction order, does the tenant still have to pay their rent during this time?
Every state has their own specific steps to follow. You can’t call the police and have a lock out done until you get the eviction order from the court.
When I get the eviction order from the court, I call the constable and have him execute the order. If they don’t leave, the constable calls the police and the police do a lock out.
You need to do a search for the landlord tenant laws in your state to make sure you follow the steps correctly. If you make a procedurial error, the whole clock has to start over again.
Don’t be scared about doing it. I evicted my tenant in 25 days start to finish all by myself. I created all the forms I needed on Word and I download the Arizona landlord’s handbook.
The key is to start the legal clock ASAP. It cost me about $200 altogether.

Depending what state our in and also alittle more of the situation? Is this a live in or are they actually renting a home or appartment?
The lease is up? Neither you or the tenant gave any notice 30 days prior to stay or vacate?
Here in Florida, The landlords seem to know to submit a Renew or Vacate letter . This is done before 30 days prior of a lease expiring. In this letter may give specifics about if rent is to increase, new owners taking over property etc. The tenant must give this back to you before 30 days of an expired lease if planning to move out.
There are time limits to vacating and total process may take even 6 months. you give them notice, go to the sherriffs office and file a complaint of tresspassing, the officer notifies the tenant, which gives them more time (and usually scares them) and if this doesn't work, file your paper work to evict at your local county court house.
Usually the landlord will get all the time in rent and sometimes court cost. Not sure how much but sure it is to file, less than $150.00. Besure to keep copies of all notices and any correspondance between you too. Also, if a tenant can prove the place to be unfit to live in, the judge may deduct from what your asking.
